Who we are
Elaki Organics (“Elaki”, “we”, “us”) sells herbal tea and skincare through this website, on WhatsApp and at our shop at JKUAT Towers, Mezzanine, M10, Kenyatta Avenue, Nairobi. We decide how your personal data is used, which makes us the data controller for the information described here.
What we collect
We collect information you give us and a small amount that is created when you use the website:
- Contact details: your name, phone number and email address.
- Delivery details: your area or estate and building or landmark.
- Order details: the products, quantities, prices and your order number.
- Payment details: your M-Pesa transaction code and any payment screenshot you choose to upload. We never ask for, collect or store your M-Pesa PIN.
- Checkout details: the details you type into the checkout, even if you do not finish your order (see Unfinished orders).
- Messages: what you send us on WhatsApp, by email, by phone or through the contact form.
- Your choices: whether you want order updates and offers by email.
- Device storage: your browser keeps your cart on your own device so it is not lost if you refresh the page.
How we use your data
- To process, pack and deliver your order, or prepare it for pickup.
- To match and confirm your M-Pesa payment.
- To send you order confirmations and updates by email or WhatsApp.
- To answer your questions and help with returns or refunds.
- To remind you about an order you started but did not finish.
- To send you offers and news about new products, only if you have agreed.
- To keep records required for tax and accounting, and to prevent fraud and misuse.
Our legal reasons
The Data Protection Act requires a lawful reason for each use of your data. We rely on:
- Contract: we need your details to fulfil the order you ask for.
- Consent: for offers and marketing emails. You can withdraw consent at any time.
- Legitimate interests: for reminders about an order you started, improving our service and preventing fraud, where this does not override your rights.
- Legal obligation: for keeping tax and accounting records.
Unfinished orders
If you enter your email or phone number at checkout and do not complete your order, we save your details and cart so you can finish later. We may send you up to 2 reminder emails, and our team may contact you on WhatsApp to help. Every reminder email has an unsubscribe link. If you do not place an order, we delete these details within 90 days.
Data stored outside Kenya
Some of our service providers store data on servers outside Kenya. When this happens, we use providers that protect personal data to the standard required by the Data Protection Act.
How long we keep it
- Orders and payment records: up to 5 years, to meet tax and accounting requirements.
- Unfinished checkout details: deleted within 90 days if no order is placed.
- Marketing preferences: until you unsubscribe.
- Messages: for as long as we need them to help you.
Keeping it safe
Only people who need your data to serve you can see it. Our admin area is protected by a login and payment screenshots are stored privately. No system is completely secure, so please tell us straight away if you think your data has been misused.
Your rights
Under the Data Protection Act you have the right to:
- Be told how your data is used.
- Get a copy of the data we hold about you.
- Ask us to correct data that is wrong or incomplete.
- Ask us to delete your data, unless we must keep it by law.
- Object to or limit how we use it, including for marketing.
- Withdraw your consent at any time.
- Receive your data in a format you can take elsewhere.
To use any of these rights, email elakiorganic@gmail.com. We will respond as soon as we can and within the time the law requires. If you are not happy with our response, you can complain to the Office of the Data Protection Commissioner at odpc.go.ke.
Children
Our products and this website are meant for adults aged 18 and over. We do not knowingly collect personal data from children.
Changes to this policy
We may update this policy from time to time. The date at the top shows when it was last changed. If we make important changes, we will let customers know by email or on this website.
